Journalists at the Los Angeles Times have overwhelmingly elected to form a union, voting 248 to 44 to be represented by the NewsGuild Communication Workers of America.<div>

<br />The union drive was launched publicly in October and culminated in an election earlier this month. Results were tallied Friday by the National Labor Relations Board.<div>
<br />Guild organizer Kristina Bui, a copy editor at The Times, said: “This was a long time coming, and we’re all thrilled that this has finally happened. The newsroom has put up with so much disruption and mismanagement, and this vote just underscores how much of a say we need to have in the decision-making process. The newsroom is demanding a seat at the bargaining table.”<br /><br />A staff organizing committee of 44 Times journalists had urged workers to unionize in response to years of corporate turnover, advertising declines and cutbacks that have shrunk The Times’ staff from more than 1,000 in the late 1990s to fewer than 400 today. Organizers said they hoped to bargain for job protections, salary increases and equal pay for men and women, and they argued that executives of the Chicago-based owner are overpaid.<br /><br />Union representation overall has been declining in the U.S. for decades — about 12% of American workers were covered by a union contract in 2017, down from 19% in 1987, according to federal data — but organized labor has made gains in the online media business.<br /><br />Over the next several weeks, the guild will hold an election to select its officers, and bargaining over a contract will begin.<div>

The response rate this year was 30% ( 1831 responses to 6128 survey requests ). Many more surveys were sent out this year as compared with 2016 (33% response rate, 1518 responses out of 4650 requests sent out). By comparison, the 2015 response rate was 30%, with 1293 survey responses received.<br />

This year there was a huge jump in responses, thanks to members taking 10 minutes out of their day to share valuable information.<br />

Last week, crew members on the Legende Films production of <i>Mustang</i> walked off the set, on strike for benefits and better working conditions. On Thursday, an IATSE contract was successfully negotiated and production resumed with a union crew! Kudos to IATSE International Representative Jamie Fry (<a href="https://twitter.com/the_Jamie_Fry" target="_blank">@the_Jamie Fry</a>) and all those that helped with the effort!<br />

<i><a href="http://www.scotusblog.com/case-files/cases/janus-v-american-federation-state-county-municipal-employees-council-31/" target="_blank">Janus vs. AFSCME</a></i> is a landmark case that the Supreme Court was deadlocked on ( 4-4 ) after Justice Antonin Scalia unexpectedly died in February 2016. With the recent appointment of conservative Justice Neil M. Gorsuch, there's likely to be a ruling.<br />

Mark Janus is an Illinois state employee who objects to paying fees to his union. Fees pay for administration, contract defense, and bargaining among other things, and have been upheld as compulsory by the Supreme Court in the past ( <a href="https://en.wikipedia.org/wiki/Abood_v._Detroit_Board_of_Education" target="_blank"><i>Abood v. Detroit Board of Education</i></a> ).<br />
<br />
Now, that ruling is coming under question.<br />
<br />
Public sector unions like <a href="https://www.afscme.org/" target="_blank">AFSCME</a>, <a href="http://www.nea.org/" target="_blank">NEA</a>, <a href="https://www.aft.org/" target="_blank">AFT</a> and <a href="http://www.seiu.org/" target="_blank">SEIU</a> form the backbone of the labor movement's political power. They have the size and the finances to compete with pro-business and corporate interests in the public policy arena. They can amplify the voice of everyday working people. The dues they collect from members make their efforts possible.<br />
<br />
The likely effect of a conservative ruling in <i><a href="http://www.scotusblog.com/case-files/cases/janus-v-american-federation-state-county-municipal-employees-council-31/" target="_blank">Janus vs. AFSCME</a></i> will be to sharply curtail the funding labor unions have to support pro-labor and pro-worker issues. This could weaken unions further, and undermine the support they provide for working people and their issues.<br />

This is not a good result for the average working person.<br />

On Sunday, July 30, 2017, wage minimums in the <a href="https://animationguild.org/wp-content/uploads/2016/05/2015-2018-Master-Agreement-Book-ms.pdf" target="_blank">Local 839 Master Agreement</a> and the <a href="http://animationguild.org/wp-content/uploads/2013/02/NickCBA2011-2015.pdf" target="_blank">Nickelodeon Agreement</a> increase. The increase to the minimums will be <b>three percent</b>.<br />

As a negotiating tactic, this is a strong statement by the WGA membership that they support the decisions of their negotiating committee. It is a show of unity during the final week of their talks, before their contract expires next week.</div>

I was talking with an artist the other day, and she asked "Why don't we get residuals? "We do," I said, "just not in the way you think."<br />

In 2016, $434 million in residual payments were contributed to the MPI Health and Pension Plans. $856 million was contributed by employers based on hours worked; when you look at the totals, <strike>more than <b>one third</b></strike> ( edit: nearly <b>one quarter</b> ) of all funding for the plans came from residuals. $856M from employer contributions, $491M from investments, $434M from Supplemental Markets & Post 60's.<br />
<br />
Instead of getting checks in the mail, Animation Guild members got the benefit of a industry-best health plan and a solid pension plan and an Individual Account Plan (IAP) that will be waiting for them when they reach retirement age.<br />
<br />
Now, it's the start of the third week of WGA negotiations. There have been a few articles <a href="http://deadline.com/2017/03/writers-guild-strike-authorization-vote-letter-wga-contract-1202051597/" target="_blank">speculating on how the talks are going</a>, but many agree - <a href="http://variety.com/2017/film/news/writers-guild-studios-contract-talks-health-care-plan-problems-1202015869/" target="_blank">health care costs</a> are a primary topic for the two sides to resolve.<br />

No plan is immune to the effects of <a href="https://www.forbes.com/sites/mikepatton/2015/06/29/u-s-health-care-costs-rise-faster-than-inflation/#34be4d726fa1" target="_blank">health care inflation</a> - which by most reports has outpaced regular inflation nearly every year for the last fifteen years. Make no mistake, <a href="https://www.nytimes.com/2017/03/24/us/politics/health-care-affordable-care-act.html?_r=0" target="_blank">healthcare and healthcare costs are a matter of national debate</a>.<br />

For Animation Guild members covered by the Motion Picture Health and Pension Plans, though, our plan is strong and looks like it will stay that way. A big part of the reason? Residuals.<br />

Yesterday marked the end of the first week of the <a href="http://www.wga.org/" target="_blank">Writer's Guild</a> negotiations with the <a href="http://amptp.org/" target="_blank">AMPTP</a>. The <a href="https://www.dga.org/" target="_blank">DGA</a> has already <a href="https://www.dga.org/News/PressReleases/2016/161229-DGA-National-Board-Approves-Tentative-New-Agreement.aspx" target="_blank">concluded their negotiations</a>, finishing up before the New Year. While we wait to see what happens next with the WGA, here are some takeaways regarding preparing for negotiations:<br />

Plan, plan, and plan some more. Dig into the details to understand things. Start early.<br />
<br />
Put together proposals that have enough detail to be implemented. Remember there are two sides in every negotiation, look for ways both sides can find a positive.<br />
<br />
Here's what the WGA, East has to say <a href="https://www.wgaeast.org/about-the-guild/what-is-the-guild/what-we-do/contracts/contract-negotiation/" target="_blank">about preparing for contract negotiation</a>. And here's what the <a href="http://variety.com/2016/film/news/wga-west-decline-surplus-negotiations-1201788326/" target="_blank">WGA, West did in preparation</a> for the talks.<br />

Know the history and the current contract. It wasn't bargained in a vacuum.<br />
<br />
Build consensus with your fellow Guild members. Be visible, but not necessarily predictable.<br />
<br />
Get a committee together - the WGA has announced a <a href="https://www.wgaeast.org/2016/12/wga-announces-negotiating-committee/" target="_blank">negotiating committee</a> that includes 32 members, including some board members and some former officers. This committee will represent the interests of their 13,000+ member guild.<br />

In 1975, the Supreme Court <a href="https://en.wikipedia.org/wiki/NLRB_v._J._Weingarten,_Inc." target="_blank">upheld</a> a <a href="https://www.nlrb.gov/" target="_blank">National Labor Relations Board</a> decision that <a href="https://supreme.justia.com/cases/federal/us/420/251/case.html" target="_blank">employees have the right to union representation</a> at investigatory interviews.</div>

Specifically, the Supreme Court ruled that the following rules must be observed:</div>

<ul>
<li><b><u>Rule 1:</u></b> The employee must make a clear request for union representation before or during the interview. The employee cannot be punished for making this request.</li>
<li><b><u>Rule 2:</u></b> After the employee makes the request, the employer must choose from one of these three options:</li>
<ul>
<li>grant the request and delay questioning until the union representative arrives and (prior to the interview continuing) the representative has a chance to consult privately with the employee;</li>
<li>deny the request and end the interview immediately; or</li>
<li>give the employee a clear choice between having the interview without representation, or ending the interview.</li>
</ul>
<li><b><u>Rule 3:</u></b> If the employer denies the request for union representation, and continues to ask questions, it commits an unfair labor practice and the employee has a right to refuse to answer. The employer may not discipline the employee for refusing to answer questions in this instance.</li>
